Travel Terms and Conditions

Price GuaranteeAll quotes are based on costs and exchange rates as of July 2016. The agreed quote is subject to change until the package deposit is reached and able to be paid to the relevant supplier. Price changes may occur by reasons outside of our control such as; adverse currency fluctuations, fuel surcharges, taxes, charges or levies imposed by any government or their agencies.
Changes in Price and ItinerariesQuoted prices will be held for 7 days only and are then subject to change. Prices are based on costs, charges, tariffs, rates, prices, taxes and levies, exchange rates, airport charges, hotel rates and other service provider’s tariffs. In the event that such fluctuations affect the prices, which we pay for such services, we reserve the right to adjust our prices as necessary at any time. Any verbal quote given is an estimate only until deposit is reached and paid to secure your booking.

Special Events and Peak Periods: Any dates selected that involve special events or are selected over a peak time, need to be disclosed by the customer at the time of booking. If at the time of booking availability is limited or no longer available for sale, the customer will be informed and alternate accommodation arrangements will be offered.

Deposit and Final PaymentsHoliday packages require a deposit of $100 per person for international packages and $75 for domestic packages. Cruise packages require deposits of up to $500 per person depending on the duration of the cruise selected. All deposits will be reached through your weekly payment plan, once you agree to the quote supplied by your travel agent. However, if we are unable to confirm the agreed quote at the time of booking with the supplier, the deposit is fully refundable. Bookings that have not reached deposit within the estimated payment plan time frame, are subject to cancellation without notice. For all holiday packages, the final payment must be made 30 days prior to departure, or 60 days for all cruises packages. If for any reason the balance of payment is not received by the due date, we reserve the right to treat the booking as cancelled and cancellation charges will apply, including full loss of deposit and any other fees and charges applied
Cancellations and RefundsOnce your deposit is reached, it is non refundable. If you decide to cancel your holiday package, your deposit is non refundable and in some cases, non-transferable. If you have paid the balance of the holiday package, external suppliers may also impose cancellation fees amounting to all, or part of the total holiday price. 

Holiday Packages: Cancellations 30 days or less prior to departure will result in 100% cancellation fees.

Cruise Packages: Once a cruise package has been fully paid, it is non-refundable and non transferable. Once a travel date has commenced, you cannot cancel or obtain a refund on any component of the booking.  

For all travel package cancellations, my Layby will charge an additional $50 cancellation fee. In some cases, the supplier will charge additional cancellation fees.

For Royal Caribbean Cruises the supplier will charge:
99 – 61 Days prior to departure 25% of the total fare per passenger, plus deposit
60 – 41 Days prior to departure 50% of the total fare per passenger, plus deposit
40 – 25 Days prior to departure 75% of the total fare per passenger, plus deposit

24 – 0 Days prior to departure 100% of the total fare per passenger

For P&O Cruises the supplier will charge:
99 - 43 days 25% of the total fare, plus deposit
42 - 15 days 50% of the total fare, plus deposit
14 days or less 100% of the total fare

Note: ‘Total Fare’ is the total quoted amount payable to us for the booking.

AmendmentsTravel amendments will incur fees. If after confirmation of your booking, you wish to change your itinerary, names of travellers or departure dates, there will be a $50 amendment fee plus any addition supplier fees, which will be quoted at the time of the change.
Not Included in Holiday Price:Passport, visa fees, travel insurance, laundry, phone calls, beverages, meals and anything that is not detailed in the itinerary, tips to tour directors, motorcoach drivers and local city guides, items of a personal nature, excess baggage, expenses, fees or costs incurred in case of illness, or of refusal of entry, detention in, or expulsion or repatriation from a country or part of a country my Layby are not liable for any expense, costs or loss incurred in relation to such matters.
Travel Insurance: Travel Insurance can be added to your holiday package. You also have the option of arranging your own travel insurance, or my Layby can recommend a provider. Any customers with pre-existing medical conditions will be required to contact the insurer directly. My Layby strongly recommends that all travellers take out travel insurance against loss of deposits through cancellation charges, baggage loss and medical expenses. my Layby makes no representations or guarantees concerning reimbursements of funds paid by you under any insurance claim. You agree not to hold my Layby responsible for any decision made by insurers, and/ or by any service providers, or requirements of any overseas country or governmental authority or overseas laws and policies.
Hotel Locations and DescriptionsPlease note that maps are not to scale and are provided only as a guide to locations. Hotel descriptions features are based on current international hotel guides and any facilities shown as included are subject to change at any time. Hotel room photographs may not be specific to actual room occupied.

Accommodation Ratings: Property ratings are Qantas Holidays Limited, views and not official ratings.
Airport and Hotel TaxesAirports and hotels have mandatory taxes in various countries. These are payable directly and will not be quoted in your estimate/booking price total.

Room Bedding GuideRequests for particular arrangements must be made at the time of your booking such as: twin share, separate beds, or a shared bed. If this is not requested at the time of booking, additional charges may apply.
Holiday VariationsIf unforeseen circumstances beyond our control require us to make necessary changes to your holiday, we reserve the right to cancel or reschedule departures and itineraries. Where it is necessary to change a hotel my Layby reserves the right to substitute accommodation of at least a similar standard.

Passports and Visas:: It is your responsibility to ensure that you have a passport with a minimum of 6 months validity from the date of return. Visa entries and any permits which meet the requirements of immigration or government authorities are also the responsibility of the traveller. Responsibilitymy Layby shall be responsible to the passenger for supplying the services and accommodations described, except where such services cannot be supplied or the itinerary used is changed due to delays or other causes of whatever kind or nature beyond our control. In such circumstances, my Layby will do its best to supply comparable services, accommodations and itineraries.

These terms and conditions represent the entire agreement between you and my Layby. In the absence of their own negligence, neither my Layby nor its agents or co-operating organisations shall be responsible for any cancellations or for acts of any other service providers concerned or diversions or substitution of equipment or any act, variations, postponements, omission or default whatsoever by air carriers, land carriers, cruise operators, hoteliers or hotels, transportation companies, or any other persons providing any of the services and accommodations to you including any results thereof, such as changes in services, accommodation or facilities necessitated by same.

Nor shall they be liable for any loss or damage to baggage or property, or for injury, illness or death, or for any damages or claims whatsoever arising from loss, negligence of any person or its direct employee or under its exclusive control, including any act, error, omission, default, or negligence of any country, government or governmental authority, officer or employee.

Other ConditionsIt is your responsibility to comply with the terms, conditions and requirements of any service provider or any country or governmental authorities, or to bear any costs or losses incurred as a consequence of you not complying with them.
Consumer ClaimShould be lodged in writing to my Layby within 30 days of return to Australia with supporting documentation. The airlines do not by virtue of their endorsement of this brochure represent themselves either as contracting with any purchaser of a holiday or as having any other legal relationship with such purchaser.
