Terms and Conditions of Purchase

When placing an order with my Layby, you are agreeing to the following Terms and Conditions of Purchase:

General Layby Information

Our minimum Layby period is four (4) weeks/ two (2) fortnights / one (1) month with a maximum Layby period of fifty two (52) weeks / twenty six (26) fortnights / twelve (12) months. If for any reason an error occurs allowing your layby term to be beyond the maximum or under the minimum allowable layby period we reserve the right to adjust your payment amount and notify you by email.

Our minimum payment is $2.50, and we accept payment by Direct Debit,  Mastercard, Visa and Bpay.

Regular payments must be made in accordance with your Layby term of weekly, fortnightly or monthly. If you need to change any of your payment or order details please contact us.

Your Layby will be delivered to your delivery address within 14 days after the final payment date, unless otherwise specified. You can change your delivery address online, over the phone or via email up to the date specified on your order confirmation. If you wish to change your delivery address within 2 days of the final payment date, please contact us as this may incur a small fee.

Your Layby order can be cancelled at any time up until the final payment date. Please see below for more info on our cancellation policy.

Contract: There will be no contract between my Layby and a customer until my Layby issues a notice confirming the customer’s order. Each contract is governed by the law of the state or territory in which the customer resides except for residents of the ACT whose contracts will be governed by the law of NSW.

Payment start date: Once you have placed your order, payments from your designated account will start on the date you selected. Alternatively, if you have elected to pay by Bpay you will need to make arrangements directly with your banking institution.

Direct Debit Authority: You will need to download and complete a Direct Debit Authority form to allow a payment to be automatically deducted from your nominated bank account. By filling out the Direct Debit Request form, you are authorising my Layby to debit your payments from your chosen account. Between 2:30pm AEST and midnight AEST on the day you have chosen, our bank debits your account electronically.. Stopping a Direct Debit payment: If you call us on 1800 183 083 by midday the working day before your payment is due we can stop a payment (i.e. before Friday midday for a Monday payment).

Missed Payments: If you miss a payment we will email you with an updated payment schedule. If you miss 2 consecutive payments with BPay or 3 consecutive payments with all other payment methods we will cancel or suspend your order and email you.

Dishonour Fee: my Layby will charge you a small dishonour fee of $3.50 to cover charges we incur from a missed Direct Debit payment. Also your bank, credit union or building society may charge you a fee due to insufficient funds.

Payments on Public Holidays: Your direct debit, or credit card, payment will come out the next working day. Please note that we are located in Sydney, therefore we observe all NSW public holidays. If you wish to skip a payment on a public holiday, or on the day after, you will need to let us know before midday on the working day prior.

How to change your order: You can change your order any time until the Last Change of order date, displayed on your order confirmation email, without incurring a ‘change of order fee’. If you change your order after this date, and before final payment date a ‘change of order fee’ will be imposed.


my Layby Cancellation policy

If you are unable to keep up your payments for any reason, please contact us as soon as possible to discuss the options that are available to you.

If your order is cancelled, cancellation charges will apply which enable us to recover our costs.
You may cancel your order at no charge if payments have not commenced.
Once payments have commenced a cancellation fee will be deducted from any refund as follows:
1.     Up to the last date to change your order on the order confirmation, a  cancellation fee of $25 will apply
2.     After the last date to change your order and up to final payment, a cancellation fee of 10% of the payments made to date will apply (The minimum fee payable is $25 )
3.   After final payment and before delivery is made, a cancellation fee will be charged to recover 'reasonable' costs related to that order.  This will depend on the circumstances and they will be explained to you at time of cancellation.
4.   Once delivery is made your layby cannot be cancelled as it is complete.

Sale Prices

Occasionally some items on our website may go on sale for a limited time.  The limited time sale price is for new orders only, not existing orders.  We can only pass on price drops to existing layby's for permanent price drops to a product, not a sale price.


Product Availability


In the event that a product you have ordered becomes out of stock or discontinued by the supplier, my Layby will offer a similar product to the same value and comparable specifications. If the alternative is not suitable, we will offer you a full refund.


Re-order & Discount Vouchers


Discount & re-order vouchers can be applied to full priced items (excludes gift cards, gift vouchers, Apple products, experience vouchers)

No further discount applies to items on sale or in conjunction with any other offer

One discount can be applied per order

Discount is valid for one month from date of issue

Discount can only be redeemed on new orders when placed online – simply enter the coupon code at the shopping card

Discount cannot be applied multiple times



You will receive a confirmation email with delivery details once your order has been dispatched. Your order will arrive within 14 days after your final payment clears in our bank account (3 days for Direct Debit, 1 day for credit card after final payment), unless otherwise specified.

my Layby deliveries are made via Australia Post or, where items are oversized, via courier. Not all products are available in all areas, that’s why it’s important we know your post code.

Delivery may be possible to selected areas outside my Layby’s usual delivery network, but additional fees may apply. Please contact us to discuss delivery to your postcode.

While every effort is made to deliver as advised, my Layby cannot accept any liability for delay due to the customer’s failure to complete customer obligations or any other reason beyond the control of my Layby (and/or its staff). my Layby cannot accept any liability resulting from a contracted party’s failure to deliver as advised.  

Change of address: You can change your delivery address online prior to 2 days from final payment date. An administration fee may apply if you change your address within 2 days of final payment date. If you change address to an area outside of our usual delivery network, additional fees may apply. Please contact us to discuss delivery to your postcode.

Returns: We will gladly replace items or reimburse you should a product be damaged in transit and in accordance with our legal responsibilities as a merchant  We are unable to accept returns for other reasons such as if you have changed your mind or have made an incorrect choice about the product and no longer wish to keep it.  If an item is reutrned to us due to an incorrect address entered at checkout or if nobody is home to accept the delivery and we are unable to contact you via email or phone for a period of 7 days, you may be charged a redelivery fee.

Free Gifts: Orders must be fully paid to qualify for free Gift. All eligible free gifts will be delivered once your order has been completed.
