Terms and Conditions of Purchase

When placing an order with my Layby, you are agreeing to the following Terms and Conditions of Purchase:

General Layby Information

Layby Period:  Our Layby Period is defined as the number of days/weeks/months from your first payment date to your final payment date.

Our minimum Layby period is four (4) weeks/ two (2) fortnights / one (1) month with a maximum Layby period of fifty two (52) weeks / twenty six (26) fortnights / twelve (12) months.

If for any reason an error occurs allowing your layby period to be beyond the maximum or under the minimum allowable layby period we reserve the right to adjust your payment amount to be within these periods and notify you by email. 

When you wish to Buy Now to obtain your order before the minimum stated layby period (4 weeks) OR shorten the length of your original payment schedule, you will need to contact us to ascertain whether we and our supplier can achieve this.  Unless we confirm via email that this can be achieved the 4 weeks minimum period will stand.

We accept payment by Direct Debit, Mastercard, Visa and BPay

Payments made by Direct Debit, Mastercard, Visa or BPay require a first payment minimum of $10 which must be made within 14x days of your order placement date.  If your first payment is not received within 14x days of your order placement date then your order will be automatically cancelled without the need to notify you of the cancellation.

 

The minimum amount for each payment following the first payment is $10.00 with the exception of the final payment amount scheduled. 

 

Regular payments must be made in accordance with your chosen payment frequency of weekly, fortnightly or monthly. If you need to change any of your payment or order details please contact us on 1800 183 083 between 9.00am and 5.00pm Monday to Friday

Your Layby will be delivered to your delivery address within 14 days after the final payment date unless there is a product delay outside of our control.  You can change your delivery address online, over the phone or via email up to the date specified on your order confirmation. If you wish to change your delivery address within 2 days of the final payment date, please contact us as this may incur a small fee.

Your Layby order can be cancelled at any time up until the delivery of your order to your nominated delivery address. Please see below for more info on our cancellation policy including cancellation charges which may apply

Contract: There will be no contract between my Layby and a customer until my Layby issues a notice confirming the customer’s order. Each contract is governed by the law of the state or territory in which the customer resides except for residents of the ACT whose contracts will be governed by the law of NSW.

 Payments

Payment start date: Once you have placed your order, payments from your designated account will start on the date you selected. Alternatively, if you have elected to pay by BPay you will need to make arrangements directly with your banking institution.

Direct Debit Authority: Where you opt to pay by Direct Debit you will need to download and complete a Direct Debit Authority form to allow a payment to be automatically deducted from your nominated bank account. By filling out the Direct Debit Request form, you are authorising my Layby to debit your payments from your chosen account. Between 2:30pm AEST and midnight AEST on the day you have chosen, our bank debits your account electronically. Stopping a Direct Debit payment: If you call us on 1800 183 083 by midday the working day before your payment is due we can stop a payment (i.e. before Friday midday for a Monday payment).

Missed Payments: If you miss a payment we will email you with an updated payment schedule. If you miss 3 consecutive payments we will cancel or suspend your order and email you.

Dishonour Fee: my Layby will charge you a small dishonour fee of $3.50 to cover charges we incur from a missed Direct Debit payment. Also your bank, credit union or building society may charge you a fee due to insufficient funds.

Payments on Public Holidays: Your direct debit, or credit card, payment will come out the next working day. Please note that we are located in Sydney, therefore we observe all NSW public holidays. If you wish to skip a payment on a public holiday, or on the day after, you will need to let us know before midday on the working day prior.

How to change your order: You can change your order any time until the Last Change of order date, displayed on your order confirmation email, without incurring a ‘change of order fee’. If you change your order after this date, and before final payment date a ‘change of order fee’ will be imposed.

 

 

My Layby Cancellation policy

If you are unable to keep up your payments for any reason, please contact us as soon as possible to discuss the options that are available to you.

If you cancel you order, cancellation charges may apply which enable us to recover our reasonable costs.

You may cancel your order at no charge if payments have not commenced.

Once payments have commenced a cancellation fee will be deducted from any refund as follows:

Cancellation Fees

You may cancel your order at any time prior to the delivery of your goods.  If you cancel your order within 21 days of the date off your original order confirmation (Cooling off period) there will be no cancellation fee.  After the cooling off period, My Layby will charge cancellation fees as follows:

·         Prior to your Final Payment Date, and providing you have made no changes to your original Order Confirmation, a $10 fee will be charged at the cancellation date.  If a change has been made to your original Order Confirmation at your request, we will recover other reasonable costs (Up to a maximum cancellation fee of $25).

·         After your Final Payment Date and before delivery of your order is made, a cancellation fee will be charged to recover other reasonable costs related to your order (Up to a maximum cancellation fee of $500)

Once delivery of your order is made, your layby cannot be cancelled as it is complete.

 

Sale Prices

Occasionally some items on our website may go on sale for a limited time.  The limited time sale price is for new orders only, not existing orders.  We can only pass on price drops to existing layby's for permanent price drops to a product, not a sale price.

 

Product Availability

 

Supplier End Of Line Stock - In the event that a product you have ordered becomes out of stock or discontinued by the supplier, my Layby will offer a similar product to the same value and comparable specifications. If the alternative is not suitable, we will offer you a full refund of the amount paid against that order

Supplier Upgrades - In the event that a product you have ordered is superseded by another model at an increased cost, we will honour our commitment to supply the product to you at the original price only when your Layby period for this product order is less than 12 weeks.  Should your Layby period extend beyond a 12 week period we will notify you of the increased and adjusted payments via email and seek your confirmation if you wish to proceed.   Should you choose to not purchase the superseded model you can contact us prior to delivery to your nominated delivery address to cancel your order and request a full refund for the amounts you have already paid for that product without incurring cancellation fees/charges.   

 

 

Re-order & Discount Vouchers issued by My Layby

Re-order and Discount Vouchers issued by My Layby can only be applied to full priced items (excludes gift cards, gift vouchers, Apple products, experience vouchers).  Re-order and Discount Vouchers cannot be applied to items on sale or in conjunction with any other offer

Re-Order or Discount Vouchers can only apply to an order with a minimum order value of $100, unless otherwise specified at the time of the promotional campaign

The Re-order Voucher is valid for one month from the date of issue.  The Discount Voucher is valid as specified at the time of the promotional campaign

Only one Discount Voucher can be applied per order.  A Discount Voucher cannot be redeemed multiple times by a customer.  

A Re-order or Discount Voucher can only be redeemed on a new order when placed online and cannot be redeemed against an existing order – simply enter the coupon code at the shopping cart. 

When a Discount Voucher is redeemed on an order and you make a change to the original order confirmation, we will advise you immediately via phone/email if the change you have made no longer meet the requirements of the Discount Voucher promotion.   Re-Order or Discount vouchers cannot be redeemed as cash.

Delivery

You will receive a confirmation email with delivery details once your order has been dispatched. Your order will arrive within 14 days after your final payment clears in our bank account (3 days for Direct Debit, 1 day for credit card after final payment), unless otherwise specified.

my Layby deliveries are made via Australia Post, or, where items are oversized indicated by a Heavy Icon  via courier. For products that do not have a heavy icon displayed, free delivery is offered to most addresses within Australia in accordance with the Australia Post Delivery network coverage.  A delivery surcharge of $50 will be charged for all products displaying a Heavy Icon and delivery will be limited to select Postcodes and/or Suburbs.  Please see the below table of Postcodes and Suburbs that are not covered within the restricted $50 surcharge delivery areas.  Not all products are available in all areas, this is why it’s important we know the post code where the delivery of your order is to be made.

We are unable to deliver to a PO Box Address as instructed by Australia Post.  Please ensure your delivery address is a physical Street Address.

 

While every effort is made to deliver as advised, my Layby cannot accept any liability for delay due to the customer’s failure to complete customer obligations or any other reason beyond the control of my Layby.  My Layby cannot accept any liability resulting from a contracted party’s failure to deliver as advised.  

Change of address: You can change your delivery address online prior to 2 days from final payment date. An administration fee may apply if you change your address within 2 days of final payment date. If you change address to an area outside of our usual delivery network, additional fees may apply. Please contact us to discuss delivery to your postcode.

Returns: We will gladly replace items or reimburse you should a product be damaged in transit and in accordance with our legal responsibilities as a merchant  We are unable to accept returns for other reasons such as if you have changed your mind or have made an incorrect choice about the product and no longer wish to keep it.  If an item is returned to us due to an incorrect address entered at checkout or if nobody is home to accept the delivery and we are unable to contact you via email or phone for a period of 7 days, you may be charged a redelivery fee.
